CHAINED AND HANDCUFFED FOR SPEAKING UP


India’s Environmental Activist  lands up in jail  for speaking at Public hearing
                                                                                                                            


On wee hours of morning of 28th May 2011,  Shri Ramesh Agrawal and Dr. Harihar Patel two longstanding and strong-willed activists from Raigarh district of Chhattisgarh were arrested from their homes by the district police. Both Agrawal and Patel had been raising concerns about the social and environmental impacts of rapid and indiscriminate industrial expansion in the district for the last several years. They had actively participated in mandatory public hearings being organised as part of the environment clearance procedure of India, wherein locally affected people and concerned citizens can raise their concerns and objections to any industrial or infrastructure related project that is to be set up.

Shri Ramesh Agrawal was part of an active group called Jan Chetana and lived in Raigarh town from where he carefully acted as a watchdog and a whistle-blower to several irregularities related to environmental compliance, water pollution and social impact issues of different project being proposed in the district. He had filed several Right to Information (RTI) applications and had on a regular basis highlighted the plight of environmental governance and disregard to environmental norms in the district before the concerned state and central level authorities and ministries. He had also taken up several matters before the National Environment Appellate Authority (NEAA) and other regulatory authorities raising concerns about faulty impact assessment, infective public hearings and instances of construction before mandatory approvals.


Dr. Harihar Patel is a resident of Gare village is a a practicing medical doctor (B.A.M.S. and DAC Aryuvedic and Acupuncture). In more recent times Dr. Patel had been leading the Adivasi Kisan Mazdoor Ekta Sangathan which had been fighting against take over of people's land due to industrial and mining activities in and around his village. He had also filed an application against environment clearance granted for setting up of the Gare IV coal mining project (by M/s JSPL) before the National Environment Appellate Authority (NEAA) proposed .

Both Agrawal and Patel had participated in a public hearing on 8thMay 2010 and raised objections against the expand an existing thermal power plant of Jindal Steel and Power Ltd (JPSL) with an additional capacity of 2400 MW. The Chhattisgarh Environment Conservation Board (CECB) had visited the plant site in February 2010 and made observations that the company had initiated construction activity even prior to the public consultation being being completed and an environment clearance issued based on people's responses and the contentions of an Environment Impact Assessment (EIA). Both Agrawal and Patel had raised these and many other issues at the public hearing along with their colleague Rajesh Tripathy.

A Complaint was filed against the Aggarwal and Harihar Patel by Jindal Power Ltd. A perusal of Complaint  filed before the Police shows that Sections 501,502,503,504,505,506 read with 34 and 35 of IPC have been registered against Ramesh Aggarwal for statement made at the Public hearing for the proposed project. The offences alleged are mainly dealing provisions of defamation, insult, making false statement with intent to cause offence against public peace etc. and criminal intimidation.

Ramesh Aggarwal has been handcuffed and chained to the bed. This is illegal and violates Supreme Court orders and clearly invites contempt of Court. (See Extracts from Supreme Court Judgement)
Ramesh Agarwal has been spearheading the fight against unplanned industrialisation and exploitation of the natural resources of Chattisgarh. He has been critical in challenging environmental clearances granted by the Ministry of Environment and Forests without proper Environment Impact Assessment studies and public consultation. Infact he has to his credit the maximum number of Appeals before the National Environment Appellate Authority. Some of the significant  issues  which Ramesh Aggarwal has brought before the Courts are: challenge to thermal power Plant, Champa, Chattisgarh, leading to the initial  revocation of environmental clearance and having a fresh public hearing conducted,  to his ongoing challenge about half a dozen projects in the region.  On a petition of Aggarwals NGO i.e Jan Chetna the Delhi High court directed that copies of approval given to projects must be made published in local newspapers so as to enable people to know the approval conditions.

We declare, direct and lay down as a rule that handcuffs or other fetters shall not be forced on a prisoner convicted or under-trialwhile lodged in a jail anywhere in the country or while transporting or in transit from one jail to another or from jail to Court and back. The police and the jail authorities, on their own, shall have no authority to direct the handcuffing of any inmate of a jail in the country or during transport from one jail to another or from jail to Court and back.
19. When the police arrests a person in execution of a warrant of arrest obtained from a Magistrate, the person arrested shall not be handcuffed unless the police has also obtained orders from the Magistrate for the handcuffing of the person to be so arrested.
21. We direct all ranks of police and the prison authorities to meticulously obey the above mentioned directions. Any violation of any of the directions issued by us by any rank of police in the country or member of the jail establishment shall be summarily punishable under the Contempt of Courts Act apart from other penal consequences under law”

NEW DELHI: After the jailing of Binayak Sen, the arrest of an environment and RTI activist Ramesh Agarwal is causing global embarrassment to the Chhattisgarh government.
The activist is renowned in the Indian and international circuit of green activists for his strong scrutiny of private projects in the state that is bursting at its seams with mining projects and thermal power plants.
Agarwal has been at the forefront of using the Right to Information Act and getting companies to share mandatory data with villagers while holding public hearings which are a must to get environmental clearances. Also his use of internet and all media formats has gained him friends across other countries.

He was arrested on May 11 this year for alleged defamatory statements in May last year against Jindal Power Limited in a mandatory public hearing of its projects. The arrest, almost a year after the complaint was filed got the activists' attention. But worse, the photographs of the man arrested and chained to a hospital bed went viral causing an international uproar.
Based on Agarwal's complaints and information against Jindal Power, the Union environment ministry had stopped work at the company project site and sent it a show cause for alleged violation of green laws. The stop work order was later revoked but the company filed a complaint against the activist for defamation and intimidation instead.
The Union environment ministry's team found the 2,400 MW project in violation but the ministry subsequently restored the clearances given to the project.

We at LIBRA India, refer and seek your kind attention to the matter of Shri Ramesh Agarwal and Dr. Harihar Patel, the environmental activists who have been receiving the wrath of administrative machinery as a consequence to their concerned and noble efforts directed towards protection and safeguard of environment.
Before we move to the main issue, we humbly seek your response on the following burning issues:

  •          Whether Democracy and Socialism have become a myth in India?

  •           Whether the rights available to any citizen in a democratic state are still available to citizens of India?

  •           Whether the right to free speech and expression as enshrined under the Constitution of India are actually guaranteed to the citizens of this country?
  •      Whether the capitalist attitude and eagerness to become a world power has completely swallowed the socialistic ideals of our country?
  •           Whether the third pillar of the basic structure – Judiciary, is still independent and free from the clutches of administrative power and pressure?
  •           Whether the statutory rights available under the Right to Information Act, 2005 are real rights or illusory rights?
  •          Whether the Administration and Judiciary are ready for the revolution brought about by right to information and the public action taken thereafter ?

The aforementioned crucial questions crop up in the mind of any prudent Indian who has witnessed or heard about the unfortunate treatment meted out to one of the prominent RTI and Environmental Activist, Shri Ramesh Agarwal.  

Shri Ramesh Agarwal has been made to suffer the consequences and fury of both the state machinery and judicial system for having exercised the rights guaranteed to him under the Constitution of India. The painful sight of Shri Ramesh Agarwal being handcuffed and ill-treated forces us to enquire that

§  Whether this will be an accepted fate of each citizen of the country who intends to exercise the Right to Information or raises voice for protection of environment?
§  Whether humanity has crossed and surpassed all levels of brutality in the rat race of attaining economic liberation and power ?
§  Whether the basic human rights can be compromised by a democratic state like India at the cost and expense of marching ahead on the road of economic and monetary development ?
      Handcuffing and chaining a human being and more so, an activist fighting for the cause of environment protection has brought shame to the Indian Democracy.  The statutory provisions under the environmental  laws in India have been dumped in the waste bins for favouring the interests of the wealthy industrialists to facilitate the smooth functioning of their ambitious business expansion projects. And, it has been proved once again that the Public hearings are for the influential industrialists and not for the general public.

     The series of torturous deaths of RTI activists or the incessant efforts of mighty corporates to put the whistle-blowers for environment protection behind the bars is a writing on the wall that all citizens will have to necessarily toe the line of the corporate desires and be a part of their wealth building exercise at the cost of flagrant violation of the environment and constitutional rights of a citizen of India.
Keeping any person in judicial custody for the offences under sections 501, 502, 503, 504, 504 of Indian Penal Code even after preliminary investigation is over, is surely nothing but a pre-trial conviction, which is against the basic criminal jurisprudence and also the Law Commission Reports.

    The inhuman treatment meted out to Shri Ramesh Agarwal is a classic, though disgraceful, example of exercise of administrative muscle power in even stigmatising the judicial independence and the most unfortunate event that has happened in the Indian democratic history.

      LIBRA India, calls upon and requests your kind intervention for taking immediate and necessary action against the people involved in this crime of afflicting torture on Shri Ramesh Agarwal and ensure his immediate release from judicial custody by upholding the constitutional spirit.

Dear Prime Minister, Chief Minister and Chief secretary of Chhatisgarh & Chairman National Human Rights Commission,

We are very concerned that Ramesh Agarwal, a long standing environmental and social advocate has been arrested in Chhatisgarh and jailed without Bail. We understand that he has been arrested on charges made by the Jindal Group of Companies alleging criminal defamation and intimidation based on statements made by Mr. Agarwal at a legally constituted Public Hearing one year ago in May 2010 on an environmental impact assessment for a 2500 MW power plant proposed by the Jindal Group. Since his arrest, we were informed that Mr. Agarwal has been denied medical attention and chained to his hospital bed in violation of his fundamental human rights recognized by the laws of India. We sincerely hope that India does not send a message to the world that its citizen who speak up and express environmental and social concerns will be treated in this manner.

We earnestly request that Mr. Agarwal be released without delay and that you ensure his safety, health and wellbeing. We also hope that these charges will not be pursued any further and that the concerns that Mr. Agarwal and other villagers expressed at the hearing will be given earnest consideration by your Government and institutions.

Nous sommes profondément préoccupés par les violations des droits civils et humains contre la personne de Ramesh Agarwal, défenseur respecté de la cause environnementale et sociale, a apparemment souffert depuis son arrestation le 28 mai 2011. M. Agarwal a été arrêté un an après que le Groupe de sociétés Jindal a déposé une plainte contre M. Agarwal à des fins criminelles "diffamatoires" et "intimider" les déclarations qui auraient été faites au cours d'une audience publique datant de mai 2010 sur une évaluation d'impact environnemental pour une usine de 2.500 MW en Chhatisgarh.
Nous, organisations membres du Réseau TAI de la République Démocratique du Congo et du Conseil pour la Défense Environnementale par la Légalité et la Traçabilité, (CODELT), malgré nos prises de position sur les opérateurs économiques travaillant pour le compte du gouvernement et même de la famille présidentielle, n’avons jamais subi pareil traitement. Or, ce qui arrive à M. Agarwal nous interpelle directement car cela soulève de sérieuses questions quant à sa sécurité, la santé et le bien-être. Bien que des demandes répétées de M. Agarwal pour les médicaments et les soins médicaux ont été formulées, vous avez tout simplement rejeté cela. C’est une honte et une violation flagrante des droits humains et des libertés fondamentales comme le droit à l’alimentation, le droit à la santé qui restent les principaux droits hérités de Dieu notre Créateur à tous, dont l’oxygène que nous respirons avec gratuité et les rayons du soleil dont vous bénéficiez sans payer quoique ce soit à la Nature. Cette situation déplorable a entraîné son admission à l'hôpital où le diagnostic est sans appel : douleurs gastriques et thoraciques, et d'autres symptômes, où il a été menotté et enchaîné à son lit, en restreignant ses mouvements. Cet acte ignoble, indigne de votre part et de la part de votre administration constitue de graves violations des droits humains. Bien plus, vous violez la déclaration universelle des droits de l’homme et du citoyen, vous violez la convention d’Arrhus en matière de participation du public à la prise de décisions et en matière d’accès à l’information et la justice, vous violez la charte européenne des droits de l’homme et des libertés fondamentales et vous violez la constitution européenne ainsi que celle de votre pays.
Le souci du Conseil pour la Défense Environnementale par la Légalité et la Traçabilité, dont je suis le Directeur Exécutif en République Démocratique du Congo, et en tant que Coordonnateur du Réseau TAI dans ce pays, est le droit à la santé et le droit à une alimentation saine de M.
